Early morning traffic stop in Irving results in felony weapons charge and DWI arrest for Dunkirk man

Irving, New York – An early morning traffic stop in Irving, New York, led to serious charges for a Dunkirk man after Troopers discovered a loaded rifle and signs of intoxication.
On April 28, 2025, at around 3:55 a.m., Troopers from SP Collins spotted a 2022 Chevrolet Colorado traveling southwest along Erie Road. After noticing multiple traffic violations, Troopers pulled the vehicle over. While speaking with the driver, identified as 22-year-old Richard J. Gardner of Dunkirk, they immediately detected the strong smell of alcohol coming from the vehicle’s interior.
During the interaction, Troopers also noticed an AR-15 style rifle clearly visible inside the vehicle. Upon closer inspection, they determined that the firearm was non-compliant with the New York Safe Act regulations. The rifle was confiscated at the scene.
Following the discovery, Troopers administered Standardized Field Sobriety Tests (SFSTs) to Gardner. According to officials, Gardner failed the tests, confirming suspicions that he was driving under the influence.
Gardner was arrested and transported to SP Collins for further processing. He now faces multiple charges, including Criminal Possession of a Weapon in the Second Degree, a Class C felony, Driving While Intoxicated (DWI), and several vehicle and traffic violations.
After processing, Gardner was arraigned in the town of Collins Court. The judge ordered him remanded to the Erie County Holding Center, setting bail at $5,000 cash or bond.
The incident remains under investigation. Authorities have not released additional information at this time regarding Gardner’s next court appearance.
